Sample Case Studies:

Plaintiffs claimed 1.9 million in tree damages. After examining their claim, We assessed Plaintiffs’ tree and landscape damages for $550,000. Both sides were at a stalemate. The case was within weeks of going to trial. Our arborist supported his evaluation using a combination of the trunk formula method, cost of cure, and tree replacements to support tree, and shrub, irrigation, erosion, and landscape damages. Plaintiffs reduced their demand to $750,000. The case settled for an undisclosed amount.

A tall tree growing adjacent to a busy highway fell across the highway. It landed on the van and killed the driver. We offered support that a dangerous condition existed prior to the failure. Plaintiffs’ were awarded an undisclosed amount.

Defense argued the plants and their growth rates were not a factor in Plaintiff’s injury. During trial we offered support that the trees and plants were not properly maintained given the growth rates for the plant species. The Plaintiff was awarded over $8 million in damages.

A very mature oak tree growing next to a busy highway had its canopy growing over the highway. One branch growing over the highway broke and landed on the car and killed the driver. We offered support that a dangerous condition existed prior to the branch failure. Plaintiffs’ were awarded an undisclosed amount.
